Gear Lube Monitor filled to top

Just changed the Gear Lube on Merc 5.7, put in about 3.5 quarts, Gear Lube monitor is above the fill lin("Do not overfill"). Do I need to take a few onces out of the drain vent to run engine, or can I run it basically just for fogging.

You can run and fog with no problem. When the drive gets hot from running under load that causes the problem. If it's overfull, the oil will push out of the bottle and into the bilge.
You can't damage anything by overfilling if that is what you are worried about, it just gets messy.
