According to a recent descision by a Lee County court, it is possable to dispose of used motor oil by simply opening the cleanout cap behind your home and dumping it directly into the sanitary sewer system.Just do not allow any law enforcement officer take a photgraph of the act( not that this would really make a difference)..<br />I know this because I brought this case before the court today, representing the State. I also saw a boater get a 50 dollar fine for speeding in a idle zone while boating in Matatcha Pass...He had pictures of the spot he was sighted at, and entire path he took to the channel, that had no signs posted!! He is appealing this ruling, But back to this oil issue.. <br />Do you change your own oil? Do you have 5gallon buckets of the goo ,waiting for a trip to the next "hazerdous waste disposal day" nearest you? Well, my friends, don't worry about it.. Just take the cap off your<br />sewer cleanout and pour it into the sewer. No need to be neat about it. If it happens to spill all over the outside of the cleanout, it will only kill the grass, but that doesn't matter. Allow pictures to be taken of this mess ,and your car still up on jacks with oil spilled all over the pad.<br />And no need to even put the oil drain pan up. Just toss it on the lawn beside the cleanout. The law enforcement officer can even take photos of all of this evidence, and prove beyond any reasonable doubt that oil was dumped into the sewer line from YOUR home, and you can be ruled innocent! Oh, sure, there is a 500 dollar fine for the first-time offence, but if the officer can't prove YOU personally dumped it, you walk.<br />Tell the judge, you have a wife and 7 children, and your gate does not lock, and that anyone could have done this,regarless that this property is yours! <br />If Johny Law DOES happen to click a pic of you in the process, just add the following statement,and you should still prevail.."Oh, that was just chocolate syrup". I didn't have a pic of that by the way,but thought I would get things ready for the next court case.<br />I Just thought I would vent. I spent most of the morning waiting for this case to appear. I sat through hearing about some guy's dog that got loose,and animal control issued 3 seperate citations,and the guy's atourney (yes a real for-money lawyer) was in a word, BRILLIANT..<br />I saw cases dissmissed because the arresting officer didn't show (no suprise there,I guess). Then this polution case. I do not know what else I could've given this court to prove the people's case! I'm done. I'll be retiring 15 months from now (none too soon). It is next to impossable to prosecute such low-life,and such low-life is paddling-over here by the raft load! They can destroy your water supply better than ANY terrorist group can ,AND GET AWAY WITH IT!!!<br />I had video tape showing the oil entering the sanitary mains,with dye that I taped myself introducing into the site. I had that dye and residual oil streaming-by the camera...This evidence was not even placed in the VCR! I had pics of the oil pan laying in the yard, mutant's "home" in the background. I had the pics of the truck REGISTERED TO THIS MUTANT, up on jacks with spillage visable underneath! Granted, this is not capital murder. But it might as well be to me, considering I have spent 29 years of my life trying to prevent this type of activity. Just as the cop on the street seeks making the streets safer and the C.G. officer seeks to make us safe on the water, I sought to try to keep our water safe to drink, and safe for the entire ecosystem.<br />The Coast Gaurd officer has lost.He must chase-down threats to manatees , in leu of threats to humans. The cop on the street has lost. He is crying over the makeshift grave of a mutants' 5year-old beaten,bruised and murdered offspring, burried behind a mobile home. I lost. I think I'm going to go fishing while I still can. I strongly urge you to do so also, and DO NOT leave your <br />children at home. Let them experiance what they soon will loose. I'm sorry if I seem a bit mellodramatic over this, but it is just a personal breaking-point for this camel's back!

There is a major problem in this US. We have better than 90% of the worlds lawyers, so no one has to be responsible for anything. I just read today that a lawsuit has been filed against President Bush because he allegedly knew all about 9/11. That attorney should be tried for treason.<br /><br />Getting back to dumping oil. I frequently see here the remnants of what we call "drop and drive". Certain folks pull their vehicle over a storm drain and proceed to let the oil drain there. The only remnants are an upside down oil filter sitting on the drain. The police can't touch them, they tried. They get accused of "racial profiling". Just like 80 year old women and mothers with children being hasseled in our airports while the guy with fuses hanging out of his tennis shoes goes right on through.<br /><br />We're messed up.

Yea, kinda ironic...But honest injun,she was! I allmost risked a contempt chrage to get her name. If I'm ever called to stand tall before the man, I want HER to represent me.<br />She was ruthless and brilliant. She was like someone from that TV show,"Law and Order".<br />She got "dog-boy" off scott-free, and didn't break a sweat. It took the court about an hour on that case..Ours was over in 10 minutes!!<br />Makes me sick, and somewhat dissatisfied with my own job performance! Oh well, the reds are biting...I'm outta here :D

My mind just doesn't work that way. I guess I'm already a dinosaur at age 43, got common sense and take responsibility for my actions. I am WEIRD.

Hey, 12Footer! <br /><br />Thanks for reminding me why I live way out in the sticks in a place I call "The Hideout". :rolleyes: <br /><br />Out here the dog wouldn't have survived and the oil would have stuck the guy with a bill for a new septic system. The Lawyer? She would have been getting off the guy who blew the dog away.<br /><br />Go fishing and enjoy. :)

Hey there 12Footer,<br />Ross Here, I wonder what would happen if some "other" mutant was to enter that mutants property and "dump" some sand down that mutants oil fill hole? Wouldn't it be a pity. The poor guy would need an engine rebuild. Not that I would know anything about this sport.<br />You keep up the good work matre, there's folk rooting for you out here. I know that isn't a lot of help but believe me the more people that know of this the better impression it makes and isn't a wasted exercise.<br />Ross

Guys, I'd say that it seems like everywhere in the western world, the legal systems are slanted in favour of the bad guy. I just hate to see them get off on technicalities when everyone knows they are guilty. But if I was you I'd just be greatful that in the USA, the really bad ones (murderers etc) seem to get decently serious sentences. Over here in comparison, the scumbags get a slap on the wrist with a wet fish. My blood boils every time I see a murderer get anything less than life without parole or the death sentence. In NZ, they're often back out on the streets after as lttle as 10 years served.<br />Sorry, I digress...

Na, I think we are on precisely the same page, Djohns. I'm just admiring the smarts involved. It's pretty obvious how I feel about people buying the law like this. I should note,that i allways attempt to stay within the law, regardless of what I think about any ordanance's ethical stand (If it ain't legal, I aint interested). But I allways admire professionaism,whether it's a doctor or a brick layer's werk. You have a very good point too!! I'll call Mrs. Saunders first thing Monday, and dig all the papers out of the trash can in my office :) <br />Ordinarily, the EPA insists on not crossing the lines of "juristiction", but this is purely a case of "Homeowner responsability", just as if his dog jumped the fence and bit his nieghbor...<br />Unfortunately for us, the Judge never gave the ordinance a good read..It states in plain words,"The home or buisness owner therein,being responsable for any such discharge into the waterways,water supply,storm drainage system, or sanitary collection system..yadayadayada"....She just plain did not read it,even after I handed it to her HIGHLIGHTED.<br />But EPA might have more clout on the federal level, however, they may shy-away from the case being "adjudicated" allready.<br /><br />62KIWI, Each stste has it's own sentencing guidlines regarding most crimes, and Murder is one such charge.Some states can give the death penalty for it, others life, and others life without parole. It's quite insane,really.<br />But JB has the plan. But even JB must not let his gaurd down. These mutants are practicaly EVERYWHERE , and they have the law on thier side,as you said.

Sad to say but I think the entire Judicial system is terrible. The majority of prosecutions are the high profile ones. Poor working people like us have to fight for every inch we get. The lawyers are making ALL the money in court. When a person attemps to represent him/her self in court they usually loose. Society is going down hill and all I am going to do is hang on to my piece of reality.<br /><br />I pray that I never have to use the judicial system on either side. I guess my "up-bringing" can best be described as "4 wall counseling". <br /><br />As for the oil issue....well there are ways to get rid of it here in VT. People have waste oil burners for heat in the winter and will even pick it up for free. We oil undercoat our vehicles every six months to keep the rust at bay. The best thing for that guy who dumped the oil would have been good old fashion justice - like cleaning the sludge traps at the local waste water plant or even a simple dose of tar and feathers. <br /><br />Bob

May be another way... here in TX we have the TNRCC, TX Natural Resources something something. They don't care who or how the oil was spilled, but the land owner pays to clean up whatever is remaining. 12' you may also have someone like this in your neck of the woods, you'd be surprised what it costs to clean up a cup of oil spilled on the ground when you get these folks involved, could be worse than any fine. Had a neighbor looked like he was running a garage in his garage and lots of oil stains etc, even thought I seen someone dumping along the fence once, gave the TNRCC a call and had them look into it, and the entire house was taped off with poison signs hanging all over it. He's no longer there.

12'r i'm right inline with you on the evironmental issues, altho i vented in the 'test' forum... i hate to vent, but this is a good place for a rare occasion. - i consider gettin rid of toxic waste pretty much altogether in the same handbasket... ;) <br />imma goin feeshin asap. just about ready to put the new mojokicker on my boat. we're catchin stripers bigtime right now. i ate fresh fillets last week. first time i ever used redpepper & texas pete over bacon greased blackened chunx- very good eatin!

Hello 12Footer <br /> You can't win. I'm a retired Paramedic and was once sued for giving a heart attack victim to rough a ride to the hospital. Ever wonder what the hospitals use to do with the spare parts after surgery. They have cleaned their act up since the 70's. Abuse is abuse. The system will never change. I'm with you lets go fishing.<br /><br /> Its time for the younger generation to take charge (God help us)

12 footer<br />If the EPA does see a violation the dirt bag will have to pay for the cleanup of everything that his oil contaminated. This would include the piepe the treatment station and any waters after the treatment station. The problem would be proving which parts his oil damaged. Who knows the EPA may make him an example.

Stinks don't it. <br />The best way for this would be for the officers to get the photo's of the guy dumping. While one oficer stands and watched the pan it was dumped out of, another get a search warrant or better yet an inspection warrant. Then you must take samples of the oil in the soil, the cleanout, and the oil pan needs to be tested for oil. Then inspect the suspects hands for oil residue. Have a lab test it to confirm oil. <br />Similar to drunk driving cases. If a person is falling down drunk, slobbering puking toilet hugging drunk, can't do a thing without a chemical test.<br />Or like the child molester that goes to court and argues that he did touch the child with his *****, but he never penetrated, and she liked it!<br />I could go on! <br />Your case could have been lost anyway at suppression because he could have had a reasonable expectation of privacy in his back yard.<br />Reasonable doubt is all it takes. He didn't have to prove he didn't do it, the state must prove he did. He just has to have a believable possibility. He won't lie, he will just simply say is it possible this happened instead. There it is, reasonable doubt!<br />I know your frusteration, feel it every monday in court!<br />It is not aperfect system, but it is the best we have!

12 footer, I'm with Kenimpzoom. I sit in on a few cases now and then for my job and while a seen a few loopy ones the courts usually seem to work. Not in the case you mention though. Keep on chargin up the hill, your needed.
