force exaust and water port?

hi, i have a newer to me engine on my boat 9.9 force question is the exaust and water ports are close to the lake water and somtimes submerged in the water i ask the mechanic at local boat shop and he said he dosent think it should be that way my anti air plate is close to even with bottom of boat maybe an inch down below boat so i dont think shaft is to long is this a design flaw or just normal all my other engines had the pee hole up high, will this cause any water to go back into cylinders because its also a exaust port thanks for all answers

Pics always help.Pic of the anti-cavitation plate against the transom.
It shouldn't allow water in the cylinders.J
